Privacy Policy and Terms of Use

PRIVACY POLICY:

Information collected through this web form is subject to our privacy policy and is collected for the following purposes only:

  1. To fulfill your registration request.
  2. To contact you regarding your registration: to verify the information supplied by you; to allow you to make changes to your information; to confirm your registration.
  3. To grant you access to this website's content.
  4. To supply you with a single account to view and modify your information.
  5. To solicit your feedback regarding the service; to inform you of changes to the service.
  6. To inform you of current and future bid opportunities, offers, news and events sponsored by ONPHA and Biddingo.com.
  7. (For subscribers) to inform you of your renewal; to issue a payment receipt; to issue an invoice.

TERMS AND CONDITIONS

ONPHA agrees to list the Consultant on its Consultants Directory (the "CD") as a value-added service of ONPHA for its members. The directory is hosted and managed in partnership with Biddingo.com. It is not the intention of ONPHA, its employees or partners (Biddingo.com) to endorse or recommend any Consultant within the Consultants Directory.

  1. As consideration for ONPHA listing me as a Consultant on its Consultants Directory, I agree to annual subscription fees, as set out below and further explained in the Fees and Registration Information section, and any other applicable charges that are provided to me when due and payable. I understand that if there are price changes I will be given thirty (30) days notice.
  2. I agree to provide ONPHA members with certain Services and Deliverables at the maximum rates, fixed for two years, as set out in the Rate Information during the term of this subscription.
  3. I agree that any contract made between me and an ONPHA member shall be between and negotiated by those two parties.
  4. I am responsible for any type of insurance required for a service.
  5. I agree to comply with all provisions and requirements of any insurance policies taken out in respect of the work of the Assignment, and with all rules and regulations concerning safety and the proper conduct of the work.
  6. I agree to comply with any and all applicable federal, provincial and municipal laws, ordinances, statutes, rules, regulations and orders in respect of the performance of this Agreement.
  7. I am responsible for all associated communication (ie. Internet Access) charges and individual business line charges in addition to any charges that result in the awarding of a contract with an ONPHA member.
  8. I understand that I will receive my own unique USER ID AND PASSWORD for access to the CD and Biddingo.com. I agree not to disclose this code to any third party. I cannot transfer this agreement and the service provided to me to anybody else unless ONPHA and Biddingo.com agree in advance and in writing.
  9. I fully understand that ONPHA and Biddingo.com cannot guarantee uninterrupted working of the service for reasons beyond control and that ONPHA and Biddingo.com will make reasonable efforts to restore the service as soon as possible. As a result, ONPHA and Biddingo.com are not in any way liable to me or others, either directly or consequentially as a result of such an interruption.
  10. I understand that ONPHA and Biddingo.com assume no responsibility or liability for the accuracy, availability, completeness or timeliness of any of the information that is available through the service.
  11. I understand that this is the entire agreement between us, ONPHA and Biddingo.com and that ONPHA and Biddingo.com do not make any other representations or guarantees regarding this service.
  12. The subscription commitment is for twelve (12) months, and provides me with access to the ONPHA CD and www.Biddingo.com
  13. No refunds on cancelled subscriptions will be given after seven (7) days of purchase.

Once payment for your subscription is received by credit card or cheque, your listing will be activated for a full year from the date of payment. Upon renewal, your account will be reactivated. Failure to renew your account within the indicated timeframe will result in suspension of your listing from the Consultants Directory.

For Energy Consultants

Consultants who list services under the Energy Management Services category are required to pay ONPHA 2% of the total contract amount between the Consultant and the ONPHA member with respect to work performed resulting from being selected from the Consultants Directory. This fee will be collected by Biddingo.com on behalf of ONPHA and represents compensation for ONPHA’s assistance in identifying and recommending Energy Management consultants listed on the Consultants Directory. Once you have a contract awarded from an ONPHA member, you are required to enter this information in your profile -- this process will be e-mailed to you once you are sent an invitation from an ONPHA member. Failure to pay the 2% fee within the indicated timeframe will result in suspension from the ONPHA Consultants Directory.

The ONPHA's Consultants Directory (the "CD") is provided only as a value-added service of ONPHA for its members. The directory is hosted and managed in partnership with Biddingo.com. It is not the intention of ONPHA, its employees or partners (Biddingo.com) to endorse or recommend any Consultant within the Consultants Directory.
ONPHA, Biddingo.com nor any of their respective employees, pre-qualify, make any representations or warranties, express or implied, including warranties of skill, non-infringement, relevant professional designation or certification, current membership in any professional group or association, experience, background, knowledge, or reliability of references or documentation that may be provided, or any other qualification or information related to any consultant or their employees listed within ONPHA's Consultants Directory.

ONPHA and Biddingo.com accept no legal liability or responsibility for the accuracy, completeness, or professional level of any services or products, or for any verbal or written advice or process that may be provided by any Consultant in this Directory. In no event shall ONPHA and Biddingo.com be held liable for any special, indirect, incidental or consequential damages of any kind or any damages whatsoever resulting from any loss of income or profits, design, construction, workmanship, materials, or other services, whether in an action for breach of contract, negligence or otherwise, arising out of or in any way arising from the services, products, or advice given by any consultant.

ONPHA and Biddingo.com do not confirm or attest to the accuracy or authenticity of any information, qualifications, or documentation provided on behalf of a Consultant, or their employees, and strongly encourages users to independently review and assess all qualifications, professional designations or certifications, and references, including the validity of any insurance certificates or policies that may be supplied by, or required of, a consultant prior to the engagement or contracting for services of any listed Consultant on this Directory. Any and all information is provided on an "as is" basis.

Users may use ONPHA's Consultants Directory to purchase products or services from Consultants on the Consultants Directory at their own discretion. In that event, a user’s contract for such services or products will be with the selected Consultant and not with ONPHA or Biddingo.com. By using this Directory or by requesting information about a Consultant, the user agrees to the terms of this disclaimer and further waives any rights or claims it may have against ONPHA, and agrees to indemnify and hold harmless ONPHA from all manner of claims, costs and expenses (including, but not limited to, legal expenses) that may arise out of any services, advice, or work performed by any Consultant.

ONPHA and Biddingo.com may change the terms, conditions and operation of this Directory at any time.
